Landlord-Tenant - A Contractual Basis for and Implied Warranty of Habitability in Residential Leases
Abstract
The Supreme Judicial Court of Massachusetts has held that in the rental of any premises for residential purposes under an oral or written lease, for a specified time or at will, there is an implied warranty of habitability.
Boston Housing Authority v. Hemingway, 293 N.E.2d 813 (Mass. 1973).
