Abstract
The United States Court of Appeals for the Third Circuit has held that under Pennsylvania law, in cases involving solely consequential damages without actual physical harm to person or property, an injured party's remedy is under the Uniform Commercial Code and section 402A of the Second Restatement of Torts is inapplicable.
