Abstract
The United States Supreme Court held that the Eleventh Amendment bars private individuals from suing their state employers for money damages under Title I of the Americans with Disabilities Act; Congress acted outside the scope of its authority under Section 5 of the Fourteenth Amendment by including state employers among those subject to the mandates of the ADA.
