Abstract
The United States Supreme Court held that the Double Jeopardy Clause of the Fifth Amendment did not prevent Pennsylvania from seeking the death penalty on retrial because neither the jury deadlock in the capital-sentencing phase proceeding, nor the resulting entry of a default sentence of life imprisonment, constituted an acquittal on the merits.
