Abstract
The Pennsylvania Supreme Court held that Act 91 of the Education Empowerment Act, which provides for mayoral control of failing school districts in select urban areas, does not violate the Equal Protection Clause of the United States Constitution or the prohibition of special laws under Article III, Section 32 of the Pennsylvania Constitution, because the legislature had a rational basis for the classification and the class had the potential of containing more than one member.
