Abstract
The United States Supreme Court held that aliens captured abroad and detained at Guantanamo Bay have a constitutional right to file habeas corpus petitions in federal court and that the Military Commissions Act, an attempt by Congress to strip courts of jurisdiction to hear such cases, was a violation of the Suspension Clause.
