Duquesne Law Review

Abstract

A California Court of Appeals has held that a person's status as a trespasser is now largely immaterial and no longer determines that he assumed the risk of personal injuries caused by a possessor's negligence.

Beard v. Atchison, Topeka and Santa Fe Railway Company, 4 Cal. App. 3d 130, 84 Cal. Rptr. 449 (1970).
